Naylor and her partner married five years ago in Massachusetts, the only state to have legalized same-sex marriage at the time. Naylor’s spouse is challenging her request for a divorce. She’s citing Texas law, which does not recognize same-sex marriage. “My spouse wanted equal rights on the day that we got married, and now that we’re back in Texas, the law allows her to keep assets from me,” Naylor said. “Now, she wants to step forward and say, ‘no I don’t want equal rights, it’s okay to violate the constitution today as long as I don’t have to share assets.’” [ News 8 Austin ] Tags: Austin, Constitution, gay divorce, Gay Marriage, Marriage, massachusetts, Same-sex, texas, Travis County
